Help this innocent victim of Police Brutality
The world witnessed a police officer murdering an innocent man (George Floyd) gruesomely while his fellow officers stood guard protecting the murderer when they were supposed to help the victim. Clearly, had it not been because of the cell phone recorded the murder, a gun would have been placed ear Mr. Floyd’s body and the murder would have been justified as self defense while the partners in crime would have corroborated each other’s version of events. Certainly, the allegations of a black man shooting at the police and being shot and killed in the process in nothing new and deemed normal in this society. But don’t you wish cameras were present at each incident? Before Mr. Floyd, Police testimony was always deemed true and credible in the media and inside the Court rooms in America. However, the by product of believing the police without scrutiny resulted in murders and thousands of wrongful convictions of innocent people.
Hopefully Mr. Floyd’s murder now changed the perception and the society begin to realize that police lies, kills and imprisons innocent people. The truth is, murderers, fabricators of evidence, thieves and people with no morals are part of each department across the country where good cops also work but they (good cops) won’t do anything about it for the fear of loosing their jobs at those cops involved with Floyd’s murder did. Unfortunately, while Mr. Floyd lost his life and shed light to the injustice. Most of the people are still ignoring the root cause of the problem. The root cause or the intent behind these atrocities, abuse and murders are the incentive to imprison, make money and secure good jobs.
People fail to realize that aside from racial bias and oppression. There lies a very lucrative business in America that encourages and promotes police misconduct. That incentive is the multi billion-dollar industry called “the prison system” where the youth of minority groups are sent where their fathers and grandfathers were sent to keep the business going before them. No other nation imprisons more people than America. Governor Cuomo criticized this fact and called the prison an industry—just like the automotive industry. I want to be clear here, I maintain that no one should be subjected to beatings, murder, false arrest or incarceration based on false evidence and unfounded criminal liability.
Ask yourself, if innocent until proven guilty is true then why people are kept in prison for years before they get their day in Court or even found guilty at trial? Why the media is even allowed to broadcast the police version of the events in any given case when the jury have not heard the evidence and the full disclosure of evidence is not made available in Court? The answer to this is, they want the jury to form an opinion and find the accused guilty before they reach the courtroom. Do you want to be subjected to this type of injustice? I was 29 years old when despite my complete innocence and the total lack of evidence that supported any finding of guilt and my involvement in Samiya disappearance. Six days after her disappearance, I was taken to the police station in handcuffs. Police detained me and subjected me to 12 hours of physical and mental torture/interrogation that involved but not limited to denial of water, food, right to go the bathroom, beatings, and denial right to counsel who was hired by my family but stood helpless behind the police station doors were only part of the abuse. When the lawyer asked when will the police release me. Cops responded to him –“maybe never and we will keep him for as long as it take”. My lawyer had then asked them to video tape the interrogation. But to ensure that the abuse is not recorded, they denied counsel’s request to video tape the interrogation.
When their abuse of 12 hours could not et them a false confession that they are used to getting from people by beating a false confession out of them, they brought a bogus charge against me alleging I had falsely reported my car missing. Nonetheless, while this was a lie. For the sake of the argument, even it that was true, nothing justified the abuse. The next day, they charged me with falsely reporting my car missing. A charge that was dismissed for the lack of evidence. I maintain, the police took my car an stored it to one of their many impound lots that is filled with cars they impound each day and used it justify their illegal and unjustified interrogation and abusive detention.
At trial, the lead Detective admitted that the car was used to bring me in so they could question me about the missing Samiya. Additionally, years later the federal court found their keeping me without a lawyer unconstitutional.
When police's attempt to beat a false confession out of and attempt to falsely imprison me based on allegations that I filed a false report about my missing car didn't stand in Court. They began harassing myself and my family to a point that I was fired from work and no matter where I applied for a job because police would call and tell everyone I was a suspect in a case, I couldn't get a job. I moved to California where most of my family lived.
In California, I legally opened my own auto mechanic shop, had a valid driver's license and had a lease and bank account in my name. But if you read police based information about me, you will find out that they are lying and claiming that I fled to California and my whereabouts were unknown. I can provide full verification of my legal residency in California on demand to show you that police lies without fearing perjury. On or about August of 2002, while my brother was visiting me from Canada. A team of detective walked in with guns drawn at me and my elderly father. They had me face the window while they dragged and placed my elderly father in handcuffs in abusively threw him inside a police car. The detective who had me face the window and gun in my back told me I could stop this by simply signing a confession. Later, they also picked up my brother and took us all to the police station.
I was given the opportunity to sign a confession to have my Dad and brother released But, if I did not sign a confession, they will put my entire family in jail. They also advised me that my lawyer's name was attached to the indictment. This meant that they could not speak to me at all. But police is above the law and do what they wish so despite this fact they made up stuff about me as if I claimed to be proud of killing Samiya. In a final futile attempt to make me sign confession to a murder theory they orchestrated and outlined on paper a story expecting me to sign and agree to what they made up. They offered my brother's freedom in exchange of me signing. They were also aware that my brother's wife was due to give birth any day and encouraged me to sign so that my brother could go back to his wife and welcome his ild in the world. Unfortunately, my brother had to hear his new born daughter's voice from prison phone.
Subsequently, I was kept in Riker's Island which is the closest place to be in hell while living for 4 years before trial and was constantly offered plea deals that I refused. My brother was out on bail. But each time he called to report that he is still in the U.S. The prosecution offered to dismiss the false charge accusing him of assisting me in disposal of evidence in exchange for him to falsely testify against me. But my brother stood firm and did not give in to their intimidation.
At trial, without any evidence that is normally expected to be found in a murder case. For example -- victim's body or any physical evidence or DNA to prove that Samiya is dead and I had something to do with it, a confession, recordings of any incriminating calls by me, an eye witness, proof that Samiya even made it to Queens or Nassau county because her final call was logged in the Bronx, no prior domestic report of me or fights between us because I only met her four months before she disappeared. Nothing was made available. They even went as far as conducting a cross examinations of a medical examiner by asking imaginary questions as if she had autopsied Samiya's body when this case offered no evidence of death. Samiya's close relative (Zalmai Khalilzad) was a politician and had got other politicians call the NYPD to find Samiya.
The prosecution used police testimonies, Sami's family's statements that were aimed at taking revenge because police misled them into believing I killed samiya and reliance on two other interested witnesses convicted me.
It must be acknowledged that the New York Jury who just went through the 9/11 devastation in New York linked to Afghanistan waited to punish someone from Afghanistan. The prosecution knew New Yorkers hated anyone associated with Afghanistan so despite the fact that I had immigrated from Afghanistan at a young age in late 80s, they constantly referred to me as "traditional Afghani"
The jury did not care about the lack of evidence and solely relied upon a detective's statement alleging that while in the plane coming to New York. I told him "hey if I killed Samiya in Afghanistan, I would have been considered a hero and sami a whore". Albeit, no recordings of me or I signing a statement existed. Jury overlooked the fact that this was the same detective who brought my Dad to pressure me into a confession and later denied ever seeing my Dad.
Seventeen years later in 2017, the prosecution’s chief witness (the mechanic shop owner) contact my appear lawyer information him that he was old and dying. He wanted to clear his conscious and come forward because the prosecutor mislead him into falsely testifying against me at trial. I was granted a day in Court and managed to substantiate his recantation with government generated documentary proof.
When it seemed obvious that I was going to win my motion to vacate judgement because the government agency documents corroborated witness recantations contradicting his trial testimonies. The lead detective along with other members of the police force took the 70 years old wheel chair bound witness to police station in Florida, had witness testify via SKYPE, positioned himself right next to him at a blind side of the camera and literally whispered into his ear to accused my lawyer and my brother of bribing him to recant. But during his testimony witness was caught being whispered to by the lead detective. But despite the fraud on Court by the district attorney’s office and the judge witnessing and admonishing them, Court still denied my motion and kept me in prison.
After the denial I proved that it was in fact the district attorney’s office and someone who lived in Canada who worked with them and knew this witness had sent money to the witness. Instead of arresting the detective and punishing him. The Court indicated that it does not matter who sent the money but the fact that money was sent is enough to deny the motion. Is this law and justice in America?
These facts are documented on the record and are available for review. And despite the Judge himself advising witness not to look or seek help from the detective and answer question. He still denied me based on scripted and false testimony ignoring government generated documents. Never in the history of the criminal justice system there has been a situation where the case lead detective caught whispering in the ear of the witness in the open Court. But despite witnessing this misconduct, t court deemed the misconduct acceptable and denied the motion.
I’m innocent of this murder but sentenced to life and have been there for the past 18 years. I would never and did not hurt or murdered Samiya Haqiqi. The documented corruption and political involvement in my case is unprecedented. Remember, this system has been in need of a serious reform for over three hundred years. But the reform must begin using cases and the people like myself who have been through it and know the ends and out of the employment of corruption.
